Non-Germane Challenge and Arbitration
The Non-Germane expenses as calculated by SEIU may be challenged by Fair Share Fee payers under Arbitration.

The Arbitration process permits the Challengers, or their representative(s), to voice Challenger’s concerns regarding how SEIU expenditures are Calculated, and/or SEIU’s definition of Germane vs Non-Germane expenditures.
In response to the many requests for assistance in this arbitration that we’ve already received, CPPEA will be attending the Non-Germane Challenge Arbitration in Sacramento (and any other Regional locations), to assist and represent all Challengers.
According to SEIU’s Policy:
- Challengers farther than 20 miles from the “Centralized” Sacramento location of the Arbitration set by SEIU can request a Regional location for Arbitration Defined Regions: Los Angeles, San Diego, and other Northern California locations).
- You may request Travel Advances, Travel Expense Reimbursements, and Union Leave, from SEIU, for attending Arbitration.
- You may have representatives (CPPEA) in attendance at the Arbitration to assist you with presenting your concerns.
CPPEA Recommendations:
- Keep records of all correspondence, To and From SEIU, regarding this Challenge and Arbitration.
- Sign the SEIU Decertification Petition, or if you, and all SEIU represented employees in your job location have already signed it, call a State Agency near you (look in the phone book) and get them to sign it too!
- File for an SEIU Travel Advance, and Union Leave for attending the Arbitration in Sacramento.
- File for a Regional Arbitration location in writing to SEIU, but plan on attending the Sacramento Arbitration, if at all possible.
- Encourage all your co-workers to also attend the Arbitration in Sacramento.
- Review all emails received from SEIU, SEIU Webmaster, SEIU Channel 1000, etc., and print out any reference(s) to actions taken by SEIU that you consider Non-Germane and be prepared to bring the print outs with you for the Arbitration.
If you can’t make it to the Arbitration, please assist a Challenger that you know will be in attendance. If you are not local to that Challenger, forward the SEIU email(s) with a brief note detailing your reasoning.
- Collect any News items pertaining to SEIU referring to any action(s) taken by SEIU that you consider Non-Germane and print them out, if possible, or take note of the incident(s), reporting entity, Date and Time of incident, Date and Time of the report, and be prepared to bring those notes with you for the Arbitration. If you can’t make it to the Arbitration, please assist a Challenger that you know will be in attendance. If you are not local to that Challenger, forward the SEIU email(s) with a brief note detailing your reasoning.
- Work Together to collect, and collate any info pertaining to action(s) taken by SEIU that you consider Non-Germane. It is much easier to do all this if you get assistance from your co-workers, rather than duplicate your efforts.
