RE: Request for verification of strike funds and reimbursement of same
Please be advised, as authorized Power Of Attorney on behalf of thousands of California state employees represented by SEIU Local 1000, I am writing this letter to request:
1. Verification of over $10,000,000, which SEIU Local 1000 has allegedly accumulated in a Strike fund account.
2. Reimbursement to the fee payers the entire amount of the Strike fund.
Following is an excerpt from the “2010-2013 SEIU Local 1000 Contract page 27:
ARTICLE 5 – GENERAL PROVISIONS
5.1 No Strike
A. During the term of this Contract, neither the Union nor its agents nor any employee, for any reason, will authorize, institute, aid, condone, or engage in a work slowdown, work stoppage, strike, or any other interference with the work and statutory functions or obligations of the State.
The above contract language indicates that SEIU Local 1000 as Exclusive Representative of over 95,000 state employees has negotiated a “No Strike” clause in all previous and current contracts.
This means that with prior knowledge of our “No Strike” contractual obligation, SEIU Local 1000 can be construed to have designed an on-going Fraudulent Conveyance in its budgeting of $1-2 million per year for a Strike Fund that can never be used for a Strike.
Also please be advised: If we do not receive a timely response by August 4, 2011 complying to this request, as we are entitled to by existing State and Federal law and SEIU policy, then it will indicate that SEIU has no intention of providing the documentation and transparency required to fulfill its fiduciary responsibility to all current and previously represented employees, and we will take all appropriate actions accordingly.
